SINAMPAHAN ng Bureau of Internal Revenue (BIR) kaninang Huwebes ng umaga ng kasong kriminal laban sa aktor na si Richard Gutierrez sa Department of Justice (DOJ) dahil sa pagsusumite umano ng pekeng tax documents at perjured affidavits para i-debunk ang P38.57-million tax evasion case na isinampa laban sa kanya noong Abril.
Si Gutierrez ay inakusahan ng pagsumite ng pinalsipikong annual income tax return para sa taong 2012 at quarterly value-added tax (VAT) returns sa second, third at fourth quarter ng 2012 sa paglabag sa Article 172 ng Revised Penal Code na may relasyon sa Article 171 ng parehong batas.
“The attached returns were deceptively made to appear to have been stamped received by Revenue District Office No. 42- San Juan City,” pahayag ng BIR.
Ayon sa BIR, Revenue District Office (RDO) No. 42 – San Juan City at ang Document Processing Division ng BIR Quezon City ang kapwa nagsertipika na ang R Gutz Productions Corp. ay walang isinampang VAT return sa nabanggit na quarters.
“Also alleged receiving officer Renato Agana denied having received the subject returns saying that the initials appearing on the said returns are not his initials and not even close to his initials,” pahayag ng BIR.
Dagdag pa rito, matapos ang kanyang eksaminasyon sa nasabing dokumento, lumalabas na ito ay dinaya at ang rubber stamp marks ay hindi kabilang sa ginagamit ng RDO No. 42-San Juan City.”
Nilabag din ng aktor ang Article 183 ng Revised Penal Code sanhi ng pagsumite ng perjured affidavits sa naganap na preliminary investigation ng kanyang tax evasion case noong July 18.
Sinabi naman ng abogado ni Gutierrez na si lawyer, Mariglen Abraham Garduque, haharapin ng kanyang kliyente ang akusasyon laban sa kanya.
“However if the alleged falsified documents are the VAT and ITR returns which Richard attached to his counter affidavit as far as Richard is concerned said documents have original stamped received from the concerned RDO of the bureau,” pahayag ni Garduque.
Nauna nang iginiit ni Gutierrez na ang R Gutz ay hindi nag-underdeclare ng tax liabilities sa taong 2012.
“I do not know if this was filed with malice or just a mistake but I just hope that this will not happen again to another taxpayer as the psychological trauma is unbearable,” pahayag ni Gutierrez. BOBBY TICZON
